This website is operated by BE & AR Maison ("we," "us," "our," or "BE & AR Maison"). We cannot guarantee that your device's display of any color will be accurate. 5.3 - We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region, or jurisdiction, on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or pricing are subject to change at any time without notice. We reserve the right to discontinue any product at any time. 5.4 - We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected. Your sole remedy for dissatisfaction with products is governed by our Returns & Refund Policy. 5.5 - We monitor return activity for abuse and reserve the right to limit returns associated with a user whom we suspect of abusing this policy, including a pattern of repeated and/or excessive returns or other fraudulent behavior. 5.6 - In the rare event that BE & AR Maison determines there has been an abuse of the return policy, we will no longer accept returns or exchanges from that account, even for orders still within their return window. If you attempt to make a return or exchange after being identified as a return policy abuser, your item(s) will be refused and/or mailed back to you. BE & AR Maison is not financially responsible for any return-ineligible items returned to us and not sent back.
Section 6 - Billing and Account Information
6.1 - We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors. Any order placed through the Site is an offer to purchase, which we may accept or reject in our sole discretion. 6.2 - You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You may not use a false email address, impersonate any person or entity, or otherwise mislead us or third parties as to the origin of your content. WE ASSUME NO LIABILITY FOR ANY CONTENT POSTED BY YOU OR ANY THIRD PARTY.

10.1 - By placing an order with BE & AR Maison, you consent to receive electronic communications from us (e.g., via email or by posting notices to our website), including notices about your account and, where you have opted in, promotional communications such as newsletters and special offers. You may opt out of promotional emails at any time by following the unsubscribe instructions provided. 10.2 - If you provide us with your mobile phone number, you consent to receive calls or text messages at that number for operational or transactional purposes, such as order and delivery updates. Marketing text messages will only be sent where you have separately opted in, in accordance with applicable message frequency, data rate, and opt-out disclosures.

THE SERVICE AND ALL PRODUCTS, SERVICES, INFORMATION, AND CONTENT PROVIDED THROUGH THE SERVICE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OR REPRESENTATIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, EXCEPT WHERE SUCH DISCLAIMERS ARE PROHIBITED BY APPLICABLE LAW. 13.2 - TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BE & AR MAISON DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NOTHING IN THESE TERMS EXCLUDES OR LIMITS ANY WARRANTY OR CONSUMER PROTECTION THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED UNDER THE LAWS OF BRITISH COLUMBIA OR CANADA, INCLUDING RIGHTS YOU MAY HAVE UNDER THE BUSINESS PRACTICES AND CONSUMER PROTECTION ACT (BRITISH COLUMBIA). 13.3 - BE & AR MAISON DOES NOT WARRANT THAT: (A) THE SERVICE WILL MEET YOUR REQUIREMENTS; (B) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) RESULTS OBTAINED FROM USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE; OR (D) ANY ERRORS IN THE SERVICE WILL BE CORRECTED. 13.4 - ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH USE OF THE SERVICE IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE OR LOSS OF DATA RESULTING FROM SUCH DOWNLOAD. 13.5 - TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BE & AR MAISON, ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SUPPLIERS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE OR ANY PRODUCTS PURCHASED THROUGH IT. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (I) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (II) ONE HUNDRED CANADIAN DOLLARS (CAD $100.00). THIS LIMITATION APPLIES TO THE FULLEST EXTENT PERMITTED BY LAW.
Section 14 - Indemnification
14.1 - You agree to indemnify, defend, and hold harmless BE & AR Maison and its owners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees from and against any claims, demands, losses, damages, costs, and liabilities (including reasonable legal fees) arising out of or relating to: (a) your use of or conduct in connection with the Service; (b) your violation of these Terms or any applicable law; (c) your violation of any third party's rights; (d) any content you submit, post, or transmit through the Service; or (e) your negligence or willful misconduct.
SECTION 15 - SEVERABILITY
15.1 - If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
Section 16 - Changes to Terms of Service
16.1 - The obligations and liabilities of the parties incurred prior to termination shall survive termination for all purposes, including obligations relating to payment, indemnification, warranty disclaimers, and limitations of liability. 16.2 - These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by ceasing to use our site. 16.3 - If, in our sole judgment, you fail to comply with any term of these Terms, we may terminate this agreement immediately without notice, and you will remain liable for all amounts due up to the date of termination.
Section 17 - Contact Information
17.1 - The failure of BE & AR Maison to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver will be effective only if in writing. 17.2 - These Terms of Service and any policies or operating rules posted by us on this site constitute the entire agreement between you and us, and supersede all prior agreements, communications, and proposals, whether oral or written, between you and us.
SECTION 18 - GOVERNING LAW
18.1 - These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
SECTION 19 - DISPUTE RESOLUTION
19.1 - We encourage you to contact us first to seek a resolution of any dispute by writing to hello@beandarmaison.com with a description of your claim and the relief you are seeking. 19.2 - If a dispute cannot be resolved informally, the parties agree that any claim or dispute arising out of or relating to these Terms or your use of the Service shall be submitted to mediation or arbitration in Vancouver, British Columbia, before resorting to litigation, to the extent permitted by applicable law. Nothing in this section is intended to limit any right you have to bring a claim before a court of competent jurisdiction in British Columbia where mandatory consumer protection law entitles you to do so. 19.3 - Any legal action or proceeding not otherwise resolved under this section shall be brought exclusively in the courts of British Columbia, Canada, and you consent to the jurisdiction of those courts.
SECTION 20 - CLASS ACTION WAIVER
20.1 - To the extent permitted by applicable law, you and BE & AR Maison agree that any claims or disputes arising out of or relating to these Terms or your use of the Service shall be resolved on an individual basis, and each party waives any right to bring or participate in a class, collective, or representative proceeding. Where applicable law does not permit such a waiver for a particular claim, that claim shall proceed on an individual basis to the fullest extent otherwise permitted.

21.1 - Your use of the Service is also governed by BE & AR Maison's Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you acknowledge that you have read, understood, and agree to be bound by the Privacy Policy.
